Pursuant to the state open records law 5 Ill. Comp. Stat. 140/1 to 140/11.6, I write to request access to and a copy of the below-listed documents submitted in connection with the following license:

Liquor license number 1A-1143455 (Licensee: GEIL LESSEE LLC), Hearth Restaurant/The Homestead, 1625 Hinman Avenue, Evanston, IL 60201.

The following are the documents I am requesting in connection with each of the above license: Full original liquor license application plus every renewal application to date, including all documents submitted in connection with the application: 

  1. Articles of Organization;
  2. Financial Disclosure Forms:
  3. LLC Formations;
  4. Operating Agreements;
  5. Partnership Agreements;
  6. Lease Agreements;
  7. Organizational Charts;
  8. Property Real Estate Information;
  9. All other documents required for submission in connection with the liquor license application. If your agency does not maintain these public records, please let me know who does and include the proper custodian's name and address. 

In order to determine my status to assess fees, please note that this FOIA request is submitted on behalf of a not-for-profit organization that would not gain any commercial benefit from the requested information.

If you choose to deny this request, please provide a written explanation for the denial including a reference to the specific statutory exemption(s) upon which you rely. Also, please provide all segregable portions of otherwise exempt material.

We released all of the requested documents that are in the City's possession, except personal information, such as home addresses, telephone numbers, personal e-mail addresses, driver's license numbers, social security numbers, and credit card numbers, were removed from the documents to protect the privacy or identity of another individual (5 ILCS 140/2(c-5) and 7(1)(b)).

Geil LLC requested a liquor license in 2019 and is not yet up for renewal.  The released files represent the complete application file and license.  To the extent documents requested are not included in the released file, they are not in the City's possession.

You can file a request for review of the redactions with the Public Access Counselor of the Illinois Attorney General either by mail at 500 South 2nd Street, Springfield, Illinois 62706, or telephone at (217) 558-0486. In addition, you have the right to seek judicial review of this denial.
